American lawmakers see the first the same as the second. Giving them a place to stay (jail) and a way to be a part of "society" (making profit for the ultra wealthy).

If you criminalize homelessness it can’t exist anymore and if it happens for whatever reason you’re giving them free housing and three meals a day.
